Terms of Service

1. Agreement to Terms

By creating an account or otherwise using Podcads (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We may update these terms by posting the revised version on this page; material changes take effect 30 days after posting.

2. What Podcads Is

Podcads generates podcast-style video advertisements and short-form cuts from product images you provide. The Service includes AI-generated voices and hosts, a licensed music catalog, an editor, export formats sized for Meta, TikTok, Instagram Reels, and YouTube Shorts, and related APIs and features available through your account.

3. Account Registration

You must be at least 18 years old and provide accurate information when creating an account. You may register with email and password or via Google sign-in. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Email verification may be required before access is granted. Notify us immediately if you suspect unauthorized access.

4. Subscriptions, Credits & Billing

Paid plans (Basic, Standard, Premium) are billed monthly or annually in advance through Stripe, our payment processor. Each plan includes a fixed number of video credits per billing cycle; one credit is consumed per generated video. Credits reset at the start of each billing cycle and do not roll over. Subscription fees are non-refundable except where required by law. You may cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period, and you retain access until then. We may change pricing with 30 days' notice.

5. Your Content & Our Output

You retain ownership of product images, copy, voiceovers, and other materials you upload ("Your Content"). By uploading Your Content, you grant Podcads a worldwide, royalty-free license to host, process, and transmit it to third-party AI providers solely to operate the Service and generate ads on your behalf. You represent that you have all rights necessary to upload Your Content and that it does not infringe any third party's rights.

Generated videos, short-form cuts, and derivative assets ("Output") are licensed to you for unlimited commercial use while your subscription is active. Licensed music tracks included in Output are covered by our catalog agreements for use within ads you publish; they may not be extracted or used outside generated Output. Podcads retains ownership of the platform, AI models, characters, templates, and underlying technology.

6. Acceptable Use

You agree not to use the Service to generate or distribute content that is unlawful, defamatory, hateful, sexually explicit, misleading in a way that causes harm, or that infringes any intellectual property or privacy rights. You may not use the Service to impersonate real individuals without consent, to create deceptive political content, or to produce content depicting minors. You may not reverse-engineer, scrape, redistribute, or resell the Service, its AI characters, or the music catalog outside generated Output. We may remove content, suspend, or terminate accounts that violate these terms.

7. AI Disclosure

Output is generated by AI models and may contain inaccuracies or artifacts. You are responsible for reviewing Output before publishing or distributing it, and for complying with advertising platform policies (Meta, TikTok, Google, LinkedIn, etc.), consumer protection laws, and any AI disclosure requirements applicable in your jurisdiction. We make no warranty that Output is fit for any particular purpose or platform.

8. Copyright & DMCA

If you believe content generated or hosted on the Service infringes your copyright, send a notice to hello@podcads.ai including: identification of the copyrighted work, identification of the allegedly infringing material and its location, your contact information, a good-faith statement that the use is not authorized, and a statement under penalty of perjury that the information is accurate.

9. Warranties & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, in no event will Podcads's aggregate liability exceed the amounts you paid us in the 12 months preceding the event giving rise to the claim, and we will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data.

10. Termination

You may close your account at any time. We may suspend or terminate your access for violation of these terms, for non-payment, or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately; previously licensed Output remains usable under Section 5. Sections related to intellectual property, warranties, liability, and disputes survive termination.

11. Governing Law & Disputes

These terms are governed by the federal laws of the United Arab Emirates and, to the extent applicable, the laws of the Emirate of Dubai, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these terms will be finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) under its rules, seated in Dubai, in English, by a sole arbitrator — except that either party may seek injunctive relief before the courts of Dubai to protect intellectual property or confidential information. Class actions and representative proceedings are waived to the extent permitted by law.
